, Shortly after the trial commenced, in January, 1976, an additional subpoena

duces tecum was served upon the defendant, Roy Martin Mitchell. After argument
n the federal defendants' motion to quash the subpoena, the district court
Genied the motion and ordered production of FBI ‘files relating to: (i) the
Plaintiffs, (ii) William o' Neal's sekiviviag concerning the Black Panther Party,
and (3ii) Counter-Intelligence documents relating to the Black Panther Party.

8/ Plaintiff sought, inter alia, (i) policy directives issued to the racial
matters squad, (ii) records relating to electronic surveillance of Fred
Hanpton and the Black Panther Party Headquarters, (iii) information obtained
by defendant Mitchell from informant Maria Fischer and other infommants, (iv)
* payment records of defendant William O'Neal (v) documents relating to the
fugitive warrant served by the FSI on June 4, 1969 (vi) decuments relating
to the hiring, assignment, payment and evaluation of defendant William O'Neal,
amd (vii) documents relating to any surreptitious entry of the residence of
the Black Panther Party or their attorneys.
o/ Specifically, with regard to the ccm files and the files of William

The 228 documents , a copy of the FBI Files of each plaintife,
as well as copies of FBI files of William.O'Neal and the Biack
Panther Party, have been furnished to plaintiffs. The Court's
