was parked in front of the walkway at the time of the .
interview, had been parked there since prior to February 4, | :
1974. The car was recognized by BENENSON as belonging to oo
a girl who lived in the same building and who is currently
out of town.
BENENSON switched off the ignition, turned off
his headlights and got out of the car. He pushed the
Griver's side of the front seat forward and lifted both
bags of groceries out onto the ground, one bag at a time.
’' When he had first exited the car, he had looked south along
the sidewalk on the west side of Josephine Street and had
noticed a group of approximately four or five people. He
estimated that, at the time he exited the car, these people
oer were approximately 100 feet from him near the second tele-
x phone pole from where his car was parked. He did not think
creas it unusual to see an individual or group of that size in
ight the neighborhood and did not pay any attention to them.
“ : After BENENSON had picked up his groceries, a
- bag in each arm, and had taken only one or two steps toward
his walkway, he became aware of someone moving immediately
behind him from a southerly direction. He stated he heard
-no footsteps but sensed the presence of one or more people.
BENENSON at that-time had the heavier bag of groceries and
probably his car keys in his right hand. His wallet was
still located in one of his lower jacket pockets, probably
the left lower pocket. He was wearing his glasses and had
his glasses case in his pocket with the car keys still in
the ‘case. ,
BENENSON whirled around aS soon as he sensed someone
behind him and encountered a white female on the sidewalk, as
..BENENSON faced in a southeasterly direction. The female poked
oe a gun in his face and moved around towards his back, keeping
- ,... the gun near his face. He did not recall in which hand the
“. female carried the gun. Ne described the gun as a long
. ‘barreled hand gun, black in color, possibly a Luger. The
a. female stated something to the effect, "The keys", or
<=). possibly “Give me the keys". She also said something to
io the effect of, "We want your car, not you". BENENSON also
