Prisons, Washington, D- G., this date, and LEWIS was released
from FCI, Terminal island, at 9:00 a.m, July 5, 1974. The
results of LUWES' appeal with the Ninth Circuit should be known
at 3:00 p.m, July 19, LO74.
AUSA VANGE advised further that on July 3, 1974,
U. S, District Court Judac HAUK vacated his previous "gag order"
prohibiiLing conmimications by either the defendant or the
Government with the news media. By July 8, 1974, AUSA VANCE
will respond to the previously-filed civil suit against '
Judes WAUK and FCL Warden WISE, pointing out that the suit
is pow moot in view of the vacation of his previous order by
Judge HAUK.
On July &, 1974, AUSA VANCE advised that Athorney
PHILLIP LENMAR, Woshisgton, D. G., for the Reporters Committee
for the Freedow ef the Press, has filed an omicus curiae
brief with regard te apport of WILL LEWIS to the Ninth Circuit
concerning ‘the issue of LEWIS' refusal to turn over SLA
tape (s) received at WTR.
On July 22, 1974, AUSA VANCE advised that on
July 19, 1974, the Ninth Gircuit Court of Appeals at San
Francisco, California, affirmed the judeament of the U. Se
District Court in Los Angeles, “hich held LEWIS in contempt
for failure to yespond to subpoena duces tecum and to answer
Federal Grand Jury questions.
The Ninth Circuit directed thet the mandate above.
should issue on the tenth day following the date of the opinion.
AUSA VANCE explained that therefore on July 29, 1974, Judge
HAUK can order LEWIS back to jail. However, during this
ten-day period, the defendant will be able to file a writ of
certiorari with the U, §, Supreme Court, which VANCE assumes
he will do, VARCE assuines that if and when the writ is
filed, Lhe Supreme Court will be asked to grant a stay until
such time as the Supreme Court decides whether or not to
grant certiorari.
