NUFSTEDLER, Ninth Cireuit Court of Appeals, Los Angeles, California. This hearing was held in chambers. -AUSA VANCE advised that Judize HUFSTEDLER refused to disturb the order of Judge BAUR relating to the reLinquishment of the subpoenaed items. Judge HUFSTENLER directed that LEWIS remain in custody until he complied with the order to provide the subpoenaed items. She did advise.that if he provided the subpoenaed items, he was to be released froin custody end a hesring was set for July 1, 1974, before the Ninth Circuit Court of Apneals as to whetlier LEWIS would be obliged to answer the questions presented to him before the Federal Grand Jury which questions he had previously refused to — answer. LEWIS remains in custody. AUSA VANCE advised that Attorney FINKEL had raised the issue that the sribpoens had arisen as a result of electronic surveitlance of LEVIS. AUSA VANCE was advised that there was no such sucveilliunce. It wis determined from the secretary. of the Grand Jury that LEWLS furnished his home address as 1625 Sunset Avenuc, Santa Monica, California, It was determined from telephone cirecLlory assistance that a telephone is listed for WILLIAM LEWIS at this address with number 392-5843. On July 2, 1974, AUSA VARCE advised that on July 1, 1974, a three-member panel of the U. Se Court of Appeals ~ (USCA) for the Ninth Circuit at Los Angeles adopted the order issued by USCA Judac HUFSTEDIER on July 19, 1974. This order was to effect that WILL LEWLS must stay in jail until he produces the subpoenaed tapes and letter, aud that if and when he did comply with that order of the District Court, he would be granted a stoy with repard to the issue as to whether or not he had to answer Crenwd Jury Questions. ’ On July 1,°1974, the USCA directed that LEWIS must stay in jail until 3:00 p.m., July 19, 1974, Meanwhile, the USCA directed that LEWES file a bricf with the court by i July 8, 1974, and the Government file an answer by July 15,: 1974. 124 - yw — = gg ener pee — EA TS, : j a eee Per ot mammtagobemg ns - fae ra an i
