1 LA 4-1627 IM/gaw/juh | On June 12, 1974, WILL LEWIS appeared with his attorney, DAVID PENKEL, on a motion bo quash the subpocna. UG. S, District Courl Judge A. ANDREW WAUK held a brief hearing, denied the motion without prejudice, and directed that LEWIS appear forthwith before the Grand Jury. Assistant U. S,. Attorney (AUSA) ARTHUR W. VANCE, JR., Los Angeles, California, advised that LEWIS acknowledged his identity, acknovledged that he knew the lecation of the subpoenard Letter and tapes and acknowledged that he had not brought the subpocnaed ftepe with him. Prior to answering virtually every qicstion, LEWIS emerged from the Grand Jury room and consulted with his attorney. He declined to answer any gucstions concerning the tapes oF how he came into possession of them claiming privileges under the First, Second, Fourth, Fifth, Ninth ane Tenth Amendments to the Constitution. At 2:00 p.m., on June 12, 1974, LEWIS was taken before Judge WAUK, Judge HAUK raised the issue as to whether $t would have been more appropriate to subpoena the KPPK Corporation rather than HhwiS personally. Judge HAUK ordered a hearing on the motion to quash for 3:00 p.m, June 17, 1974. ‘The Sacramento Division was requested to determine the status of KPIFK Corporation (Pacifica Foundation) and to determine the officers thereof. On June 13, 1974, the Sacramento Division furnished the following information: , ; The corporate index of the Department of Corporations, Secretary of States Officc, Sacramento, California, revealed the following information: Pacifica Foundation was incorporated in the State of California on August 24, 1946, with an address of 2217 Shattuck Avenuc, Berkeley, California.
