knowm friend of Frank Nash, Vernon ¢. Liiller and Hervey J. Bailey, ané
apparently engaged in criminal activities with them and their friends,
He has not been definitely identified in this case, but several witnesses
described a man similar to him in appearance as an actual participant in
the massecre, No process of arrest has been iasued for him in connection
with this case, however, he ies wanted for bank robberies at Minneapolis,
Minnesota, and Crom Point, Ihdianse Roports from underworld sources
indicate that Phillips was murdered by other gangsters near Ste Paul,
Minnesota, during July, 1933, but the Division bas been unable to verify
suck informatione Efforta are being made by the Division to effect the

James Clerk, alias yin Clark alias Jack Yartin, former subject Ie0e #1192.
Clark was apprehended at Tucuncari, New Mexico, by local officers on
October 6, 1933, and returned to the State Penitentiary at Lansing,
Kansas, from which place he was an escape and where he had been serving
4 life sentences, Clark again escaped from the Kansaa Penitentiary on
January 19, 1939 and is now at larges Clark wae originally wanted for
questioning in view of his former associations with Bailey, Underhill and
Brady with whom he escaped from the Kansas State Penitentiary on Memrial
Day, 1935. Clark was viewed by the various witnesses in this case and
not identifieds No concerted effort is being made by the Division to bring
about hie apprerension at the present time in connection with this cast,

Ed Davie, alies W, FE. Davis, alias Keith Stone, aliaa Sebron Edward Davis,
Slias George~Allen, alias George Kei th“allen, To0. #1193. Davie escaped
from the Kansas State Penitentiary, Lansing, Kansas, on Memorial Day,
1933, with Harvey J. Bailey, Wilber Underhill, Robert Brady, James Clark
and others. It will be noted that this escape was lese then three weeks
before the massacre took places He is the only one of the original members
of the Memorial Day break who bas not been brought into custody altha gh
Ciark has again escapeds He was serving a life aentence in the Kansag
State Penitentiary and was already an escape froma life sentence in the
Oklahoma State Penitentiarye Davis ia known as a vicious killer and bank
robbere He has not been identifiel as an actual participant in the massacre.
No process of arrest is outstanding for him in connection with thie case
although he is wanted for questioning.
