New Jersey, to Assistant United States Attorney Donald Horowitz, who advised that from the background of Charles Augustus Livezly, they feel that the invoking of criminal process is not the solution to this case, ue. Horowitz advised that in his opinion, Livezly is not dangerous and ‘is no real threat to. the recipients of the letters, Me, Horowitz advised that he feels that a medical evaluation of Livezly is the responsibility of local authorities and that a full disclosure of the facts of this matter and the nature of the letters should be brought to the attention of local authorities, Mr, Horowitz advised that under the rules of Federal Criminal Procedure no medical evaluation of Livezly could be effected by the Federal Government until Livezly is either convicted or has entered a plea of guilty to the charge against him, Mr. Horowitz advised that he will not authorize issuance of a warrant, and he declined prosecution in this natter. Mr, Hilbert Scarduzio, Assistant Camden County Prosecutor, was advised of the above facts on September 15,. ‘1967.
