case transferred to another district,rather unconstitutional-
ly dismissed it [ With-Prejudice ] attempting to continue the

In Berger vs.United States, 295 US 78 at 81(1935) the Court
said:"Section 269 of the Judicial Code,as amended(28 U,S.C.
§ 391 provides: "'On the hearing,of any appeal,certi-
uorari,writ or error,or motion for a new trial,in any
case civil or criminal,the court shall give judqment
after an examination of the E~N-T-I-R-E record before
the court Without regard to technical errors,defects
or exceptions which do not affect the substantial
rights of the parties.'"
