Re: Surreptitious Entries
DETAILS:
In a 4/21/76 request, the Civil Rights Division
asked whether or not our Inspection Division had any
investigations underway or contemplated regarding surreptitious
entries performed by Bureau personnel, particularly, but
not limited to, two entries performed in 1972 and two entries
in 1973, all against "alleged WUO persons."
Information concerning the four specific entries
mentioned by the Civil Rights Division, as well as information
about numerous other entries which occurred since
January 1, 1966, was furnished to Headquarters following.
New York's review of 25 volumes of SAC folders discovered in
that office.
On learning of the discovery of this material,
Director Kelley indicated that the documents in question
should be reviewed, especially that material showing entries
falling within the Statute of Limitations,
Prior to any action in this regard, we received
on 4/21/76. a Departmental request. Since a review of
this material by our Inspection Division might conceivably
jeopardize, or act at cross purposes to the Civil Rights
Division's inquiry, a decision was made to speak with
Assistant Attorney General Pottinger for his views.
On 4/22/76, Mr. Pottinger's Deputy, Mr. James Turner,
was contacted by Mr. Adams, and the areas of possible conflict
as regards this review by the Bureau and Department were
discussed with him. Mr. Turner communicated our views to
Mr. Pottinger, who was then out of town, and Mr. Pottinger
