Cr rn Bates to Gebhardt Memorandum RE: HEARNAP : At 5:44 pm, an LAPD SWAT Team leader directed a sugrender announcement to the individuals in the residence at'1466 East 54th Street through a builhorn. After one minute, the order was repeated and shortly thereafter a young Negro male came out of the front door of the house. After 2 additional surrender pleas by the LAPD over the bullhorn, an additional Negro male also exited in the same manner: as above. The bullhorn announcements by the LAPD continued for 8 minutes. No FBI personnel participated in these surrender announcements. | At 5:53 pm, an LAPD SWAT Team member fired 2 tear gas projectiles into the aforementioned house and heavy bursts of automatic gunfire emanated from the SLA pad immediately. The LAPD returned the gunfire and a gun battle ensued between members of the LAPD SWAT Teams and the individuals within the dwelling. At approximately 6:00 pm, the 5-man FBI SWAT Team was directed by the ADIC of the LAO to furnish firearms and tear gas support to the LAPD SWAT Teams. The FBI SWAT Team entered the rear of an abandoned residence at 1445 East 54th Street, The windows and doors of the 1445 East 54th Street house were covered with plywood. The plywood covering on the windows located on the east side. of this residence near the front was removed to permit viewing the 1466 East 54th Street residence. As the plywood covering was removed the position was hit by incoming gunfire believed to be from automatic and/or semi-automatic weapons fired from 1466 East 54th Street; Two FBI Agents of the SWAT Team then fired 16 rounds of 40 mm CS irritant gas projectiles at the 1466 East 54th Street location. These gas projectiles were fired from M-79 grenade launchers. These gas projectiles were directed at the front and rear side windows on the west side of the house from a distance estimated at 50 to 60 yards. Automatic and semi-automatic gunfire from the dwelling was continually directed at FBI SWAT Team position. (The LAPD report entitled "SLA In Los Angeles” cited property damage at 1445 East 54th Street for bullet holes at $200.) Two FBI Agents of the SWAT Team returned the gunfire using M-16 rifles. One Agent fired 20 rounds, another 18 rounds of .223 caliber military ball ammunition. A third Agent using a Remington Model 700 BDL rifle fired 10 nen -3-
