gt -” Bates to Gebhardt Memorandum RE: HEARNAP "If any of the said persons shall be killed in re@isting lawful arrest, the Attorney General may pay any p of the reward money in his discretion to the person or pefsons whom he shall adjudge to be entitled thereto but no re@ard money shall be paid to any official or employee of the Départment of Justice of the United States." OBSERVATIONS: The above could be initiated upon the authorization of the Attorney General and administered by the Criminal Division of the Department of Justice. In our request to the Attorney General we would seek approval for Director Kelley to announce the reward as well as propose the recommended conditions of the reward to the Attorney General for his consideration. It would be incumbent upon the substantive desk to provide factual information to the administering body which may or may not be the Criminal Division of the Department in order for them to adjudicate the reward. The most compelling reason to offer a reward at the present time would be for the thrust it would provide for nationwide publicity. A reward announcement would receive widespread publicity but may also serve to impede our progress in a more substantial area by the numerous leads that it would generate. Also a reward announcement may be construed as a public admission that the FBI is unable to find the fugitives through their own resources. For the above reasons, we believe that a reward announcement should not be made at this timé. The reward concept will be continually evaluated, and _ upon approval, will be initiated when we reach the point where meaningful and productive leads are exhausted. ACTION: 7 information. Qu \X * -_
