4.2.2.
(U) Reporting Requirements.
(U) As soon as possible, FOs must notify CACHTU regarding the initiation of predicated child-
abduction investigations, which involve significant FBI involvement. During nonbusiness hours,
notification can be made through the Watch Operations Unit of the Crisis Management &
Intelligence Coordination Section. Notification may be made by telephone or e-mail, but it must
be followed up within 15 calendar days through the submission of an FD-705 Kidnapping
Offense Report Fom..
(U) An FD-70S *Kidnapning Offense Report Form" supplemental report must be submitted by
the office of origin within 15 calendar days after one or more of the following developments
occur:
1. (U) A ransom has been demanded.
2. (U) The subiect(s) have been identified or arrested, and a federal or state process has been
initiated.
3.(U) The victim has been located.
4.(U) The case has been closed..
4.2.3.
(U) Child of Tender Years
(U) Following the mysterious disappearance of a "child of tender years' (age 12 or younger), all
FOs must establish contact with the LEA that initiated the alert of the abduction or that is
geographically responsible for investigating the abduction, including the command post or police
department or both. The FO should make an offer of assistance and coordinate additional needed
resources. Additionally, the FO should make an assessment of that agency's response and gauge
the need for the FBI to establish a lead role in the matter. If warranted, a 7C (Child Abductions -
No Ransom) or a 7E (Child Abductions - Ransom) investigation must be opened.
(U) If a local LEA declines FBI assistance in a child-abduction case, the facts and circumstances
clarifying the FBI's noninvolvement and contact with the investigating LEA must be
documented by the FO.
4.2.4.
(U) ChiIdren Ages 13 to 17
(U) In an instance involving the disappearance of a child ages 13 to 17, the FO should utilize a
measured response that is based on the totality of the circumstances of the disappearance. In
some cases, children with histories of running away have been targeted and abducted by
strangers. Other cases may have involved children who voluntarily ran away of their own accord
but who were later held against their will. For this reason, FOs must consider the totality of the
circumstances and the investigative information developed in both initiating and closing 7C
(Child Abductions - No Ransom) cases involving the disappearances of children ages 13 to 17.
4.2.5.
(U) FederaI Jurisdiction in Kidnapping Matters
(U) Federal jurisdiction in a kidnapping matter is established when the offender utilizes any
interstate instrumentality (e.g., streets, highways, airports, telephones, or the Internet) or foreign
commerce while committing the offense. In effect, federal jurisdiction extends to virtually all
kidnappings, except to those transpiring exclusively on private property (i.e., the kidnapping,
from abduction to return or recovery, occurs where the child already resides).
